Terms

Last revised September MMXXVI

These terms govern your use of heirandspare.com and any purchase from Heir & Spare, Door 15, 99 South 3rd St., Hudson, New York 12534. By using the site or buying from us you accept them. Our Privacy Policy forms part of these terms.

The nature of antiques

Every piece is old, and most have lived full lives. Wear, repairs, restoration and the marks of time are part of their character. We describe condition, dates, origin and materials honestly and to the best of our knowledge, but attributions are opinions, not guarantees, unless expressly stated in writing. Photographs and measurements are given in good faith; please ask if a detail matters to you, and do view in person where you can.

Prices and availability

Prices are in US dollars. Each piece is one of a kind and remains available until paid for. If a price is shown in error, we may decline or cancel the order and refund you in full. Sales tax is added where the law requires.

Payment

Pieces up to $7,500 may be bought by card through Stripe. Pieces above $7,500 are sold by invoice, payable by bank transfer or as the invoice directs. When you begin checkout, the piece is reserved for thirty minutes; if payment is not completed, it returns to the collection. A sale is final once payment is received and confirmed.

Delivery and collection

  • UPS Ground. Smaller pieces within UPS limits are sent insured by UPS Ground.
  • Freight or courier. Larger pieces travel by freight or specialist courier, quoted separately and payable before dispatch.
  • Collection. Free from Door 15 by arrangement.

Risk passes to you on delivery or collection. Please inspect on arrival and tell us of any damage within forty-eight hours, with photographs, so we can make an insurance claim on your behalf.

Returns

Because each piece is unique and described with care, sales are final unless the piece arrives damaged in transit or materially differs from its description. In either case, write to us within seven days of delivery and we will arrange a return and a full refund, or a repair where you prefer.

Holds and the Inner Circle

Trade membership is by invitation and at the house's discretion; we may decline an application or end a membership without giving reasons. Members may hold up to five pieces for forty-eight hours each; a hold lapses automatically and carries no obligation to buy. Trade prices and early sight are confidential to members. Tax-exempt purchases require a valid resale certificate on file, and members are responsible for their own tax obligations on resale.

Your account

Keep your sign-in details to yourself; you are responsible for what is done under your account. We may suspend accounts used to abuse the site, hold pieces in bad faith or mislead the house.

The site and its contents

Words, photographs, the Dispatch and our marks (the crossed keys, the seal and the name Heir & Spare) belong to the house. You are welcome to share links; please do not copy or reuse our content without permission. The site is offered as it is; we try to keep it accurate and running but cannot promise it will always be either.

Liability

Our liability for any purchase is limited to the price you paid for the piece. We are not liable for indirect or consequential loss. Nothing here limits rights you have under law that cannot be excluded.

Governing law

These terms are governed by the laws of the State of New York. Any dispute belongs to the state and federal courts of New York, though we would much rather resolve it over a conversation first.

Changes

We may revise these terms from time to time; the version in force when you place an order applies to that order.
